One arrested, one dead, after shooting in car on Highway 412 near Sand Springs

Tulsa County deputies say the two suspects set up a man to be robbed.

4/8/2021 Update – After investigating, the Tulsa County Sheriff’s Office found that the driver, Mariley Lopez, 17, and the man in the back seat, Xavier Foster, 19, set up the victim to be robbed.

The intended victim, a 20-year-old man who was in the passenger seat of the car, had recently bought a gun, and Lopez and Foster set up a meeting where they could rob him of it, according to police.

Deputies say Lopez picked the victim up from his home in Sand Springs on Tuesday night while Foster hid in the backseat of the car.

Foster tried to rob him and exchanged gunshots with the victim as they drove along Highway 412.

Lopez crashed into a cable barrier after she was shot, deputies say.

Foster died from his wounds, and Lopez was arrested after being released from the hospital Wednesday morning.

Lopez and the 20-year-old victim were shot in the leg. Both are expected to recover.

Lopez is facing charges for first-degree murder and attempted robbery with a firearm.


Three people were shot, one fatally, while driving down Highway 412 near South 81st West Avenue in Sand Springs around 11:30 p.m. Tuesday night.

According to the investigation, three people were in the car while driving down Highway 412. One man in the backseat reportedly pulled out a gun and the passenger in the front seat of the car pulled out a gun of his own.

According to police, shots were fired by both the man in the back seat and the man in the passenger seat. The man in the back seat was fatally shot.

Both the woman driving and the man in the passenger seat suffered gunshot wounds and were transported to the hospital.

Officers believe this was a failed armed robbery by the man in the back seat of the car.

The Tulsa County Sheriff’s Office believes the two in the front seats of the car were unaware there was someone in the back seat.

Sand Springs police responded to the call initially and the Tulsa County Sheriff’s Office has taken over the investigation.

Highway 412 near the South 81st West Avenue exit was shut down for almost three hours while officers investigated.
